Medicaid ABA in Pennsylvania is delivered by licensed IBHS agencies under 55 Pa. Code Chapter 5240, and the documentation standard is not buried in a payer manual: section 5240.41 is regulation. Every service note carries the date, time, duration, and setting, the ITP goal the service addressed, a description of the outcome, and the renderer's signature. OMHSAS republished its compliance guide for the chapter in December 2024. The matching rule set lives in the rules library in the Penguin Health app.
§5240.41(a)(8): date/time/duration/setting, the ITP goal, the outcome, the signature.
The OMHSAS Regulatory Compliance Guide for Chapter 5240.
§5240.41(b): a quality review of the record within six months of the first entry, then at least annually.
Per BACB certificant data, with demand reported to exceed certified supply.
The regulation
IBHS replaced the old BHRS "wraparound" system in 2020 and brought agency licensure with it, so documentation in Pennsylvania is inspected at licensing as well as at claims review. The individual record holds the written order, the assessment, the ITP, consent, and the documentation of each service, and §5240.41 says what each piece includes. The December 2024 Regulatory Compliance Guide is the state's current reading of it.
The checklist
Each item below names its regulation section and the Penguin rule that checks it. The distinctive Pennsylvania element is the second one: the service is identified to a goal in the ITP, so a note that describes activity without naming the plan goal does not meet the regulation.
| The note shows | What that means in practice | Source | Rule |
|---|---|---|---|
| Date, time, duration, and setting matching the billing | When and where the service happened and for how long, consistent with the billed times and place of service. | §5240.41(a)(8)(i) | PA-1 |
| The service tied to a goal in the ITP | The treatment plan goal the service addressed, named on the note. | §5240.41(a)(8)(ii) | PA-2 |
| A description of the outcome | What the service produced, with data or specific observations, not activity alone. | §5240.41(a)(8)(iii) | PA-3 |
| The renderer's signature | Signed by the staff person who provided the service. | §5240.41(a)(8)(iv) | PA-4 |
| Each entry signed and dated by its writer | The writer's signature carries a date, on every entry in the record. | §5240.41(b)(2) | PA-5 |
| The full record when a restraint occurred | A note that describes a manual restraint carries the nine-element record. Notes with no restraint pass. | §5240.41(a)(12) | PA-6 |
| A setting consistent with the billed place of service | The setting in the note and the place of service on the claim describe the same place. | §5240.41(a)(8)(i) | PA-7 |
Chapter 5240 requires entries to be signed and dated but sets no note-completion deadline, so no deadline rule is claimed or checked.
The record is reviewed for quality within six months of the first entry and at least annually after.
IBHS agencies are licensed by OMHSAS, and staffing tiers follow the chapter's qualifications.
In the rules library
Open the rules library in the Penguin Health app, choose Pennsylvania IBHS ABA, and click Add to organization. Rules your organization already has are left alone, so adding the set twice only fills gaps. After adding, edit any rule or add your own alongside them.
Each rule runs only on notes billed to Pennsylvania Medicaid HealthChoices payers. Penguin checks the CentralReach payer name, so a Pennsylvania rule never fires on a commercial note in the same organization, and an organization whose payer names differ edits that match after adding the set.
Penguin reads signed session notes from CentralReach, read-only, after signature and before the claim, and runs the set on every note. Deterministic rules compare record fields. AI rules are read by the AI, which returns a pass or fail with a one-sentence reason.
Seven rules for IBHS-delivered ABA: the per-service documentation elements, ITP goal linkage, signatures, and the manual-restraint record.
Every failure ships with QA guidance for that program code: an educational email, numbered action steps, and a QA email pre-filled with the date of service and a link to the note. Each reviewer action is written to a write-once audit log with seven-year retention, which is the record you hand a licensing reviewer next time. Billing Medicaid in more than one state? The rules library covers sixteen, including New York and Virginia.
Maintained by Penguin
Pennsylvania's standard lives in regulation, which moves slowly, and in the compliance guide, which does not. The Pennsylvania set is tied to both documents, not to a template written once.
The Chapter 5240 table of contents for regulation amendments and the OMHSAS Regulatory Compliance Guide for interpretive changes. Penguin fetches the sources on a schedule and archives every revision.
We rewrite the affected rule, cite the document that changed it, and date the review. The set shows its sources and review date in the library.
An updated rule runs in the next scheduled validation and on demand against notes you have already reviewed, so a changed requirement shows you exactly which past notes it touches.
