A 2024 state audit estimated MassHealth overpaid ABA providers $16.8 million for services delivered outside the required supervision ratio, and in February 2026 MassHealth directed its plans to recoup 2024 ABA payments. Massachusetts is the densest BCBA market in the country, and it is the one state actively taking ABA money back. The documentation standard lives in the MBHP medical necessity criteria, updated as recently as February 2026, and the matching rule set lives in the rules library in the Penguin Health app.

The clawback
The clawback itself is about the supervision ratio: services by paraprofessionals beyond what one licensed analyst can supervise. That is a staffing-data question, and Penguin's supervision reporting covers it from data the organization supplies. But every recoupment review also reads the record, and Massachusetts has a steady drumbeat of enforcement where documentation decided the outcome: AG settlements over services not delivered or not properly documented, an indictment over allegedly fabricated records, a trial conviction over billing for sessions that never happened. The operative documentation standard is the MBHP/Carelon ABA Medical Necessity Criteria, effective January 1, 2025 and updated October 2, 2025 and February 15, 2026. MBHP is the MassHealth behavioral-health vendor; the other MCEs publish aligned criteria.
The checklist
Each item below names the criterion behind it and the Penguin rule that checks it. Massachusetts sets no note-completion deadline, so none is claimed.
| The note shows | What that means in practice | Source | Rule |
|---|---|---|---|
| A summary of the treatment provided | What was delivered in the session, not only that a session occurred. | Continuing Stay 5(b)(i) | MA-1 |
| How the treatment time was utilized | An accounting of the session time. Documented activity that leaves billed time unexplained is a gap. | Continuing Stay 5(b)(ii) | MA-2 |
| The member's response to treatment | How the member responded, with data or specific observations. | Continuing Stay 5(b)(iii) | MA-3 |
| No unjustified non-therapeutic time | Breaks, meals, play, and peer interaction in the billed window carry a documented clinical justification tied to goals. Naps always fail. | Treatment Intensity 12(b)(vii) | MA-4 |
| No school settings | Place of service 03 on a plan-billed ABA claim fails outright. | Coverage scope · Exclusion 4 | MA-5 |
| Mitigation when progress is lacking | A note reporting lack of progress or regression also documents the response: a protocol modification or a planned reassessment. | Continuing Stay 6 | MA-6 |
Progress monitoring includes graphs that visually demonstrate change from baseline, maintained across sessions.
The treatment plan is updated no less than every six months, with data against baseline and updated goals.
MassHealth requires ABA providers to hold specialty accreditation: center-based providers by January 1, 2027 (with a corrective-action window announced in 2026), others by January 1, 2028.
In the rules library
Open the rules library in the Penguin Health app, choose MassHealth ABA, and click Add to organization. Rules your organization already has are left alone, so adding the set twice only fills gaps. After adding, edit any rule or add your own alongside them.
Each rule runs only on notes billed to MassHealth payers. Penguin checks the CentralReach payer name, so a MassHealth rule never fires on a commercial note in the same organization, and an organization whose payer names differ edits that match after adding the set.
Penguin reads signed session notes from CentralReach, read-only, after signature and before the claim, and runs the set on every note. Deterministic rules compare record fields. AI rules are read by the AI, which returns a pass or fail with a one-sentence reason.
Six rules under the MBHP/Carelon medical necessity criteria: the daily-note summary elements, non-therapeutic time, the school-setting exclusion, and barrier mitigation.
Every failure ships with QA guidance for that program code: an educational email, numbered action steps, and a QA email pre-filled with the date of service and a link to the note. Each reviewer action is written to a write-once audit log with seven-year retention. And supervision reporting, the exposure actually being clawed back, runs from the supervision data your organization supplies. Billing Medicaid in more than one state? The rules library covers sixteen, including Maine and New York.
Maintained by Penguin
The MBHP criteria changed three times in fourteen months. The MassHealth set is tied to that document, not to a template written once.
The MNC-ABA document on the MBHP provider site. Penguin fetches the sources on a schedule and archives every revision.
We rewrite the affected rule, cite the revision that changed it, and date the review. The set shows its sources and review date in the library.
An updated rule runs in the next scheduled validation and on demand against notes you have already reviewed, so a changed criterion shows you exactly which past notes it touches.
An estimated $16.8M in overpayments for ABA outside the 10:1 supervision ratio.
Updated medical necessity criteria and performance specifications, plus the accreditation mandate with its 2027 and 2028 deadlines.
Plans told to recoup 2024 ABA payments for claims outside the supervision ratio. Providers are contesting it; the exposure is real either way.
The third revision of the MNC-ABA in fourteen months.
LibraryMA-1 through MA-6 are built against this revision.
Checked against the February 15, 2026 criteria. Current.
When MBHP updates the criteria, the set is updated and every organization using it gets the change.
